Fraud prevention has been the rallying call of protectionists who have called for clamping down so hard on granting immigration benefits that virtually no one will want to bother applying (assuming they could jump through all of the hoops placed in front of them). Despite lacking real evidence that fraud is a serious problem in our employment-based immigration system, the antis keep banging this drum. And it's killing our economy. In the 1930s, protectionists thought they were saving jobs for Americans when they imposed trade barriers that kept out foreign goods. Today's protectionists are focusing on immigrant workers. But rather...

My cousin got a H1B petition approved (via the lottery system) last year. One consultant in the US had filed his H1B, and my cousin was asked to pay for the entire process, which he did. But, nothing happened last year after that, because the job market turned worse. My cousin did not appear for the visa interview.
Now, when he is trying to get in touch with the consultant, he is not getting any response. What are my cousin's options now?
Thanks.

Printing Office's Work Stacks Up (http://www.washingtonpost.com/wp-dyn/content/article/2007/04/03/AR2007040301829.html), By Lyndsey Layton, Washington Post Staff Writer, Wednesday, April 4, 2007
The Congressional Record, for instance, is printed daily and captures every debate, vote, parliamentary maneuver, tribute to a fife-and-drum corps, post office naming, and utterance by members on the floor of the House and the Senate. It averages 250 pages.
Ordinarily, the legislative process is paper-intensive. From the moment a bill is introduced by a member of Congress to its signature on parchment paper by the president, the printing office must print 10 different documents related to that piece of legislation, often doing the work overnight.
The agency is producing 3 million or 4 million pages a week for Congress from its 1.5 million-square-foot North Capitol Street headquarters, the largest information-processing, printing and distribution facility in the world. Tapella could not say how that compares with the workload under the last Congress.
All the talk of paper led some members of the panel to question why the printing office, which was created in 1813 when printing was a central tool in communication, hasn't gone all-electronic.
"Are you completely transitioning to a digital system as some point?" the subcommittee chairman, Rep. Debbie Wasserman-Schultz (D-Fla.), asked during a hearing.
The printing office is in the middle of a $29 million technological shift that will allow it to store and maintain all federal documents electronically, Tapella said. About 92 percent of everything it publishes now is available in an electronic format, said Michael L. Wash, the agency's chief technical officer. The agency produced its first online edition of the Congressional Record two weeks ago.
But Turri said the printing office will stick with paper until Congress directs it to do otherwise.
"It's kind of like the newspaper business," said Rep. Zach Wamp (R-Tenn). "They know things are going electronic, but they know people are going to want to read their newspaper with their coffee."

If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

Hi,
I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(
Thanks,
Pradeep

Short term disability usually is not considered a Public Charge. This is because they are usually carried by private insurance or state agencies and not federal ones. However, I would check if one can claim SDI under CA law if one is not a Permanent Resident or a U.S. Citizen.

It's hard not to watch in amazement as protesters from across Iran are managing to get videos and pictures out to the world of their fight for liberty despite the fact that most journalists are barred from reporting. They are using communications technology as their weapon against the regime and the camera phone has been at the center of it all. Two years ago I honored Philippe Kahn on this site as my immigrant of the day. Kahn, a French immigrant to the US, invented the camera phone in 1997 so that he could take pictures of his new child...

Hi -
I got my I-140 approved back in 2008 and last year my H1b was extended for another 3 years.
I am planning to change job now and once the new company transfers my H1b will it be extended for another 3 years or for the remaining duration of my current H1B.
Also what happens if my current employer revoke the I-140 after i change job?
Until when can i start the GC process with new company so that i don't go out of status and keep getting extensions until i get my GC?
Thanks

Hi,
I have applied for H1B extension for 3 years based on my I 140 approval. I have submitted all relevant documentation except for client letter.
My current H1 expires in Oct and we are expecting our baby in October as well. I would like to know what would be my options in case my H1 extension in denied. I cannot leave with the new born atleast untill december (need time to get passport n visa for the baby) and I wouldn't want to get into any legal issues like staying in US n not being in status.
Looking forward to your advice and suggestions

I have visa stamp in the name of previous employer and I 797 from current employer. I have traveled with these and had no problems at re-entry.
But previous employer has completed processing of my H1B cancellation. Can I still re-enter with visa stamp in the name of previous employer?
Thanks!
